“The main criteria for appointment is a thorough knowledge of real estate law, and especially title examination requirements,” Mr. Schaefer explained. “Substantial experience and involvement in real estate law and experience working with registered land matters are key for Registered Land Examiners.”
In addition, Mr. Schaefer is one of only a small group of attorneys to be certified by the Ohio State Bar Association as a specialist in residential real estate law.
The purpose of registered land is to make title to real estate conclusively ascertainable through this certificate, which is issued by the County Recorder’s Office. Property owners often want to register their land to firmly establish the rights and duties associated with their property and to conclusively establish good title and in that respect such a proceeding is similar to an action to quiet title.
“It offers peace of mind to those who own such property,” Mr. Schaefer said. “And I can help clients because any such proceedings are required to be handled by a Registered Land Examiner.” Mr. Schaefer explained that while Registered Land Examiners are appointed by the Court, it is up to the client as to which examiner to use.
There are many instances involving real estate which require the services of a registered land examiner. Typically, one is not required merely to transfer property, unless the property is involved in a proceeding in Probate Court, or is held in trust, or is the subject of a foreclosure action, in which case the services of a Registered Land Examiner would be required in order to pass title. Thus, law firms which handle probate estates or work in estate planning will often have need for these services, as well as lending institutions which routinely serve as trustees, or which are involved in mortgage lending would also have the need of these services.
